- ABOUT THESE TERMS
1.1 These Terms of Use govern your use of the Loci mobile application and any related services (collectively, the "App"). The App is operated by Loci App Ltd of 45 Gresham Street, London, EC2V 7BG ("we", "us", or "our").
1.2 By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1.3 You must be at least 16 years old to use the App. If you are under 18, you confirm that you have parental or guardian consent to use the App.
- ABOUT THE LOCI PLATFORM
2.1 The App is a free community platform that provides information about local public services in your geographical area.
2.2 The App allows you to:
(a) search for and view information about local public services;
(b) access contact details and service information;
(c) view service locations and opening hours; and
(d) receive notifications about service updates, if enabled.
2.3 All services listed on the App are provided by third parties. We do not provide the actual public services ourselves and accordingly do not accept any liability for any failure of those services. The information presented in the App is gleaned from publicly available sources and from direct integrations with service providers. The information is not generated or verified by us in any way. Accordingly, we do not accept any liability for any inaccuracy of any information in the App.
Data from the Office of National Statistics is used for identification of postcodes and wards and is licensed under the Open Government Licence v3.0 - https://www.nationalarchives.gov.uk/doc/open-government-licence/version/3/
- YOUR ACCOUNT AND REGISTRATION
3.1 You may need to create an account to access certain features of the App.
3.2 When creating an account, you must:
(a) provide accurate and complete information;
(b) keep your login credentials secure and confidential;
(c) notify us immediately of any unauthorised use of your account; and
(d) take responsibility for all activities that occur under your account.
3.3 You may delete your account at any time by contacting us trust@lociapp.co.uk
- HOW YOU MAY USE THE APP
4.1 You may use the App for your personal, non-commercial purposes to access information about local public services.
4.2 You may share information from the App with others, provided you do not remove any copyright notices or other proprietary markings.
4.3 You must comply with all applicable laws and regulations when using the App.
- HOW YOU MAY NOT USE THE APP
5.1 You must not use the App to:
(a) violate any applicable laws or regulations;
(b) infringe any intellectual property rights;
(c) transmit any harmful, offensive, or inappropriate content;
(d) attempt to gain unauthorised access to the App or our systems;
(e) interfere with the proper functioning of the App;
(f) use the App for any commercial purposes without our written consent;
(g) attempt to reverse engineer, decompile, or disassemble the App;
(h) create derivative works based on the App; or
(i) use the App in any way that could damage our reputation or that of the public services featured.
5.2 We reserve the right to suspend or terminate your access to the App at any time and without notice if you violate these Terms or if your continued use of the App may cause any damage or harm to us or any third party.
- YOUR CONTENT AND INFORMATION
6.1 If the App allows you to submit content (such as reviews, comments, or feedback), you retain ownership of that content.
6.2 By submitting content, you grant us a non-exclusive, royalty-free licence to use, display, and distribute your content in connection with the App.
6.3 You are responsible for ensuring that any content you submit:
(a) is accurate and not misleading;
(b) does not infringe any third-party rights, including intellectual property rights;
(c) is not offensive, harmful, or inappropriate; and
(d) complies with applicable laws.
6.4 We reserve the right to remove any content that violates these Terms or that we consider inappropriate or for any other reason whatsoever.
- OUR CONTENT AND INTELLECTUAL PROPERTY
7.1 The App and all content, features, and functionality are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
7.2 Information about public services is obtained from various sources, including government databases and third-party providers. We do not claim ownership of this public information and do not make any claim as to the accuracy or completeness of such information.
7.3 Our trademarks, logos, and service marks may not be used without our prior written consent.
- PRIVACY AND DATA PROTECTION
8.1 Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms.
8.2 By using the App, you consent to the collection and use of your information as described in our Privacy Policy.
- THIRD-PARTY SERVICES AND LINKS
9.1 The App may contain links to third-party websites or services that are not owned or controlled by us.
9.2 We are not responsible for the content, privacy policies, or practices of any third-party websites or services.
9.3 The App may integrate with third-party services (such as mapping services) to provide functionality. Your use of these services is subject to their respective terms and policies.
- DISCLAIMERS AND LIMITATIONS
10.1 The App is provided on an "as is" and "as available" basis without any warranties of any kind.
10.2 We do not warrant that:
(a) the App will be uninterrupted or error-free;
(b) the information provided through the App is accurate, complete, or current;
(c) the App will meet your specific requirements; or
(d) any defects in the App will be corrected.
10.3 Information about public services is provided for general guidance only. You should verify important information directly with the relevant service provider.
10.4 We are not responsible for any changes to public services, including closures, changes in opening hours, or modifications to services offered.
- LIABILITY
11.1 To the maximum extent permitted by law, we exclude all liability for any loss or damage arising from your use of the App.
11.2 Nothing in these Terms excludes or limits our liability for:
(a) death or personal injury caused by our negligence;
(b) fraud or fraudulent misrepresentation; or
(c) any other liability that cannot be excluded or limited by law.
11.3 Our total liability to you for all claims arising from or related to these Terms or the App shall not exceed £100.
11.4 You agree to indemnify and hold us harmless from any claims, damages or expenses arising from: i) your use of the App; ii) your violation of these Terms of Use; and/or iii) your infringement of any third-party rights.
- TERMINATION
12.1 You may stop using the App at any time by deleting it from your device.
12.2 We may suspend or terminate your access to the App at any time, with or without notice, if:
(a) you breach these Terms;
(b) we are required to do so by law; or
(c) we decide to discontinue the App.
12.3 Upon termination, your right to use the App will cease immediately, but these Terms will continue to apply to any prior use.
- CHANGES TO THESE TERMS
13.1 We may update these Terms from time to time to reflect changes in the law or our services.
13.2 We will notify you of any material changes by posting the updated Terms in the App, on our website or by other reasonable means.
13.3 Your continued use of the App after any changes constitutes acceptance of the new Terms.
- GENERAL PROVISIONS
14.1 These Terms constitute the entire agreement between you and us regarding the App.
14.2 If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
14.3 Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
14.4 These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the English courts.
14.5 You may not assign or transfer your rights under these Terms without our written consent.
